Please be aware that while attending events held at Townsville Turf Club and/or entering this venue, each patron acknowledges that they may be photographed, filmed, and recorded in any way.

Each patron:
consents to being photographed, filmed and/or recorded by or on behalf of Townsville Turf Club for Townsville Turf Club’s marketing, advertising and promotional purposes (including, without limitation for promotion of Townsville Turf Club); and
agrees to Townsville Turf Club collecting, storing, handling, accessing, managing, transferring, using and disclosing collected personal information about them including but not limited to name, details and images in connection with the photography, film and recordings for Townsville Turf Club marketing, advertising and promotional purposes;
if the patron is an owner of any horse present at the racecourse or whose image is displayed at the racecourse, consents to their horse/s being photographed, filmed and/or recorded by or on behalf of Townsville Turf Club and for Townsville Turf Club to use and reproduce such photographs, films and recordings (including the colours worn by the relevant jockeys) for Townsville Turf Club’s marketing, advertising and promotional purposes;
assigns any and all intellectual property rights they may have in any such photographs, films and recordings to Townsville Turf Club, and agrees that Townsville Turf Club and its successors and assigns will own all right, title and interest in such photographs, films and recordings and may exercise all intellectual property rights existing in or in relation to any such photographs, films and recordings throughout the world in perpetuity, free from any liens, claims, encumbrances or right of termination by the patron or anyone else;
agrees the rights granted to Townsville Turf Club are perpetual, and they will not receive any payment, royalty, compensation, or any consideration (whether monetary or otherwise) from Townsville Turf Club in connection with the photography, filming and recordings or the marketing, advertising and promotional material;
acknowledges and agrees that any Promotional Materials which refer to them, expressly or by implication, are, at the date of publication, made in good faith and are not intended to defame or offend them or bring them into disrepute and, to the best of Townsville Turf Club’s knowledge, are true and correct; and
waives absolutely and irrevocably any moral rights they may have in or in relation to any of the photographs, films and recordings referred to in this notice.

Do not enter this venue if you do not wish to be subject to the foregoing.
