Cluden Park Fashions on the Field Terms and Conditions

Categories are open to males and females aged 18 years and over
Contestants and/or their outfits are not permitted to promote commercially a brand, store or designer or receive a commercial benefit from appearing in the competition.

Contestants must not receive any payment or benefit from a third party (including any commercial enterprise) for entering, participating or otherwise in connection with this Competition.

Contestants must not in any way disparage or make derogatory comments in any form (whether verbally, electronically or otherwise) about the Promoter or judges, any competition associated with the Fashions on the Field competition or other contestants at any time.

If a Contestant is in breach of any of these terms and conditions, the Promoter may (at its absolute discretion) disqualify the Contestant from the Competition and/or any other Fashions on the Field competition.

The decision decided by the number of votes is final and no correspondence will be entered into.

For the overall Fashions on the Field Season winner category; should there be more than one entrant with the same winning points score the judges’ decision is final. In the event there are only two entrants with the highest score, the judges’ will announce one entrant as the winner and the 2nd entrant as the runner up.

Prize/s awarded to contestant must remain property of contestant.
Committee members, staff and immediate family of Cluden Park are not eligible to participate.

All winners and runners up will be notified on the day.
Prizes are not transferable, exchangeable or redeemable for cash.
Travel and accommodation prizes subject to terms and conditions.
Contestants entering as Lady of the Day or Queen of The Cup cannot enter as Contemporary and vice versa.
Winners must collect their FOTF prizing on the day in which it was won, or arrange for collection from the Cluden Park Racecourse Administration office. (Address: Racecourse Road, Cluden, Townsville). Collection must take place within 7 working days. Failure to collect prizing within 7 working days will result in the winner forfeiting the prize/s.
Contestants agree that their competition photos may be used on promotional materials at any time in the future.

PHOTO AND FILM CONSENT

Please be aware that entering a Fashions on the Field competition at Cluden Park, each entrant acknowledges that they may be photographed, filmed, and recorded in any way.

Each entrant:

consents to being photographed, filmed and/or recorded by or on behalf of Cluden Park for Cluden Park’s marketing, advertising and promotional purposes (including, without limitation for promotion of Cluden Park); and
agrees to Cluden Park collecting, storing, handling, accessing, managing, transferring using and disclosing collected personal information about them including but not limited to name, details and images in connection with the photography, film and recordings for Cluden Park marketing, advertising and promotional purposes;
if the patron is an owner of any horse present at the racecourse or whose image is displayed at the racecourse, consents to their horse/s being photographed, filmed and/or recorded by or on behalf of Cluden Park and for Cluden Park to use and reproduce such photographs, films and recordings (including the colours worn by the relevant jockeys) for Cluden Park’s marketing, advertising and, promotional purposes;
assigns any and all intellectual property rights they may have in any such photographs, films and recordings to Cluden Park, and agrees that Cluden Park and its successors and assigns will own all right, title and interest in such photographs, films and recordings and may exercise all intellectual property rights existing in or in relation to any such photographs, films and recordings throughout the world in perpetuity, free from any liens, claims, encumbrances or right of termination by the patron or anyone else;
agrees the rights granted to Cluden Park are perpetual, and they will not receive any payment, royalty, compensation, or any consideration (whether monetary or otherwise) from Cluden Park in connection with the photography, filming and recordings or the marketing, advertising and promotional material;
acknowledge and agrees that any Promotional Materials which refer to them, expressly or by implication, are, at the date of publication, made in good faith and are not intended to defame or offend them or bring them into disrepute and, to the best of the Cluden Park’s knowledge, are true and correct; and
waives absolutely and irrevocably any moral rights they may have in or in relation to any of the photographs, films and recordings referred to in this notice.

Do not enter this venue if you do not wish to be subject to the foregoing.
